Terms of Service
The terms that govern use of the JOMI website, mobile application, admin tools, and related services.
Effective date: March 14, 2026
These Terms of Service govern your access to and use of the JOMI website, mobile application, admin interfaces, and related services provided by Ivan Chabanenko, Lutherstrasse 12, 39112 Magdeburg, Germany ('JOMI', 'we', 'our', or 'us').
By creating an account, downloading the app, using the website, or accessing any JOMI service, you agree to these Terms. If you do not agree, do not use the service.
JOMI is currently operated by a private individual under the JOMI brand rather than through a separate company. If you use JOMI on behalf of a company or another organization, you represent that you have authority to bind that organization to these Terms.
1. Eligibility and account registration
- You must be at least 16 years old to use JOMI, and if the law in your jurisdiction requires a higher age or parental authorization, you must meet that requirement before using the service.
- You must provide accurate registration information and keep it current.
- You are responsible for protecting your credentials and for all activity that occurs under your account unless prohibited by law.
- We may suspend or require additional verification for accounts that appear compromised, fraudulent, abusive, or otherwise unlawful.
2. What JOMI provides
JOMI provides tools for meal planning, grocery-list generation, food and wellness logging, account management, and related website and administrative functionality.
Features may change over time. We may add, modify, remove, or limit features if needed for security, legal compliance, technical integrity, or product development.
3. Health and wellness disclaimer
JOMI is an organizational and informational tool. It does not provide medical advice, diagnosis, treatment, or emergency services. Nothing in the service is a substitute for advice from a qualified physician, dietitian, or other licensed healthcare professional.
You should consult a qualified professional before relying on meal, nutrition, activity, or weight-related information if you have a medical condition, eating disorder history, pregnancy, allergies, or other health concerns.
4. Acceptable use
You may use JOMI only in compliance with applicable law and these Terms.
- Do not misuse the service, attempt unauthorized access, interfere with infrastructure, or reverse engineer non-public parts of the service except where mandatory law permits it.
- Do not upload malware, spam, infringing material, deceptive content, or data you have no right to use.
- Do not use JOMI to build competing datasets, scrape the service at scale, or bypass rate limits, technical controls, or security mechanisms.
- Do not use the service in a way that could harm other users, our providers, or the reliability of the platform.
5. User content and inputs
You retain ownership of the content and data you submit to JOMI, including meal data, logs, and account information, subject to the rights needed for us to operate the service.
You grant us a non-exclusive, worldwide, limited license to host, store, reproduce, adapt, and process your content solely as needed to provide, secure, improve, and support the service and to comply with law.
6. Intellectual property
JOMI and its related software, design, branding, documentation, text, graphics, and service content are owned by us or our licensors and protected by intellectual property laws.
Except for the limited right to use the service under these Terms, no rights are granted to you by implication or otherwise.
7. Third-party services
JOMI may integrate with third-party services such as Apple Health, Google Fit, hosting vendors, email providers, payment providers, app stores, or authentication services.
Your use of those third-party services may be subject to separate terms and privacy notices. We are not responsible for third-party services we do not control.
8. Fees, billing, and subscriptions
JOMI currently does not offer paid plans, subscriptions, or in-app purchases. If we introduce paid plans, one-time purchases, subscriptions, or renewals later, we will present the applicable pricing, billing cycle, tax treatment, cancellation terms, and any additional contract terms before you are charged.
For users in the EU or Germany, mandatory consumer information, statutory cancellation rights, and any lawful exceptions for digital content or digital services will be presented at checkout if paid services become available.
9. Beta features and availability
Some features may be labeled beta, preview, test, or early access. Those features may be incomplete, may change materially, and may be discontinued without notice.
We do not guarantee that the service or any feature will always be available, uninterrupted, secure, or error-free.
10. Suspension and termination
You may stop using JOMI at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created legal or security risk, failed to meet payment obligations if applicable, or used the service fraudulently or abusively.
Where appropriate, we may provide notice and an opportunity to cure before termination, but we may act immediately if necessary to protect the service, other users, or legal compliance.
11. Privacy
Our Privacy Policy explains how we handle personal data. By using JOMI, you acknowledge that we may process personal data as described in that policy.
12. Disclaimers
To the maximum extent permitted by law, JOMI is provided 'as is' and 'as available' without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the service will meet your requirements, achieve any health or weight-loss outcome, or be compatible with every device, browser, jurisdiction, or third-party service.
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, data, or business opportunities.
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service or these Terms will not exceed the greater of: (a) the amount you paid us for the service in the 12 months before the event giving rise to liability; or (b) one hundred euros or U.S. dollars equivalent if you paid nothing.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for intent, gross negligence, fraudulent misrepresentation, death or personal injury caused by negligence where mandatory law so provides, or mandatory product and consumer rights.
14. Indemnity
To the extent permitted by applicable law, you will indemnify and hold harmless JOMI, its affiliates, officers, employees, and contractors from claims, liabilities, damages, and expenses arising out of your unlawful use of the service, your content, or your breach of these Terms.
This section does not apply where prohibited by consumer-protection law.
15. Governing law and venue
These Terms are governed by the laws of Germany, excluding its conflict-of-laws rules, unless mandatory law in your place of residence requires otherwise.
If you are a consumer in the EU or Germany, you keep any mandatory rights granted by the law of your country of residence, and nothing in these Terms removes those rights.
Any disputes that are not subject to mandatory consumer venue rules will be brought in the courts with jurisdiction for Magdeburg, Germany.
16. Dispute resolution for U.S. users
If you are located in the United States, you may be asked to resolve certain disputes through binding arbitration and a waiver of class actions only if that mechanism is separately presented to you and lawfully agreed. If no separate arbitration agreement is presented, this section does not create one by itself.
17. German and EU consumer information
- Statutory rights of consumers under EU and German law remain unaffected.
- If you are a consumer in Germany, we are neither obligated nor willing to participate in dispute-resolution proceedings before a consumer arbitration board unless mandatory law requires otherwise.
- If paid digital services are offered later, the pre-contract information, cancellation instructions, and any waiver of withdrawal rights for immediately supplied digital content must be shown before checkout.
18. Changes to the service or terms
We may update these Terms from time to time. If we make material changes, we will post the revised Terms, update the effective date, and provide any notice required by law.
If you continue using the service after the updated Terms take effect, you agree to the revised Terms, except where additional consent is required by law.
19. General terms
- If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
- Our failure to enforce a provision is not a waiver.
- You may not assign these Terms without our prior consent, except where mandatory law provides otherwise. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- These Terms, together with any additional terms presented for specific features and our Privacy Policy, form the entire agreement between you and us regarding the service.
For questions about these Terms, contact info@jomimeals.com. If JOMI later moves to a company structure, these Terms will be updated to reflect the new legal operator before that change takes effect.
